General terms of sale

1. Purpose

These terms govern distance sales between SARL Galerie Calderone (20 rue Levavasseur, 35800 Dinard, SIREN 794 601 393, hereinafter "the gallery") and any person placing an order through the website, whether for a work of art (painting, sculpture, ceramics, photography, textile) or a shop product (book, print, edition, object). Any order implies unreserved acceptance of these terms. Sales concluded in the gallery are governed by the terms displayed on site.

2. Works, products and availability

The works are unique pieces or limited editions, described with their dimensions, medium and year; shop products are described on their page. Photographs are as faithful as possible, with no contractual value as to colour nuances. Availability is updated daily from the gallery's inventory; a work may nevertheless be reserved or sold between two updates. The gallery confirms availability before any payment is taken.

3. Prices

Prices are in euros, including all taxes, excluding shipping, insurance and, where applicable, customs duties for delivery outside the European Union. Works without a displayed price are offered "on request": the price given by the gallery is valid for the period stated in its reply. The gallery may change its prices at any time; the applicable price is the one confirmed at the time of order.

4. Orders

The website does not yet offer online payment. An order takes place in three steps:

• the customer sends a request through the contact form, by email (info@galeriecalderone.com) or by phone, specifying the work or product and the delivery address;
• the gallery confirms availability, price, delivery costs and lead time, and sends an invoice or a payment link;
• the sale is concluded on receipt of full payment. The gallery then sends the order confirmation.

A work can be reserved without commitment for a few days, on request; the reservation lapses without payment by the stated date.

5. Payment

Payment is made by bank transfer, by card via a secure payment link, or at the gallery. For a work, payment in instalments may be agreed in writing; the work is then delivered after the final payment. The gallery remains the owner of the work or product until the price is paid in full (retention of title clause). Businesses can consider a leasing arrangement, set up with a partner finance company.

6. Delivery

Shop products are shipped from Dinard within three working days of payment, in reinforced packaging; collection from the gallery is possible during opening hours. Works are delivered by a specialist carrier, packed and insured, within a period agreed with the customer; costs are stated before the order. The customer checks the condition of the parcel on receipt and reports any damage to the carrier and the gallery within three days, in writing, with photographs. Risk passes to the customer on delivery of the goods.

7. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumers have fourteen days from receipt to withdraw, without giving reasons, by writing to info@galeriecalderone.com or by post to the registered office. The goods are returned in their original packaging, in perfect condition, within fourteen days of notification; return costs and insurance are borne by the customer unless otherwise agreed. The gallery refunds within fourteen days of receiving the returned goods. The right of withdrawal does not apply to personalised goods (dedication, custom framing, commissioned work) or to sales concluded in the gallery.

8. Guarantees and authenticity

Each work comes with a certificate of authenticity issued by the gallery or the artist; signed editions are numbered. The customer benefits from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a defect, the customer writes to the gallery, which offers repair, replacement or refund depending on the nature of the goods.

9. Intellectual property

Buying a work or product does not transfer any reproduction or performance rights, which remain the property of the artist (Article L.111-3 of the French Intellectual Property Code). Any commercial use of the image of a work requires the permission of the artist or their rights holders.

10. Personal data

Data collected with an order is used to process it, for invoicing and to follow up the relationship; it is kept for as long as accounting obligations require. Details are given in the privacy policy.

11. Disputes

These terms are governed by French law. In case of difficulty, the customer first contacts the gallery; they may then use a consumer mediator free of charge (Articles L.611-1 et seq. of the French Consumer Code), whose details are available on request, or the European platform ec.europa.eu/consumers/odr. Failing that, the French courts have jurisdiction.
