Terms of sale

1. Seller and purpose

The seller is Galerie Calderone SARL, with a share capital of €1,000, registered office at 20 rue Levavasseur, 35800 Dinard, France, SIRET 794 601 393 00034, EU VAT number FR91794601393 (hereinafter “the gallery”).

These terms govern distance sales concluded on the website, whether of a work of art (painting, sculpture, ceramics, photography, textile) or of a shop product (book, limited edition print, edition, object). The buyer accepts them before any payment. Sales concluded at the gallery are governed by the terms provided on site.

2. Works, products and availability

Works are unique pieces or limited editions, described with their technique, dimensions and year; for an edition sculpture, the buyer chooses the cast (number, patina) among those available. Shop products are described on their page. Photographs are as faithful as possible but not contractually binding as to colour nuances.

Availability is checked at the time of payment. A work is reserved for the buyer during the thirty minutes of the payment page; if payment does not go through, it becomes available again. Limited edition prints are printed to order, then signed and numbered by the artist.

3. Prices and VAT

Prices are shown in euros, all taxes included. French VAT applies at 5.5% for works of art and books, and at 20% for other products (limited edition prints, textiles, objects). Shipping costs are added to the price; they are calculated and shown in the cart before payment, according to the size of each item and the destination country.

For delivery outside the European Union (including the United Kingdom, Switzerland and French overseas territories), the sale is an export: prices and shipping costs are charged without French VAT, and import duties, taxes and fees in the destination country are payable by the buyer. Works without a displayed price are available on request.

4. Ordering

The buyer adds works and products to the cart, chooses the destination country or collection from the gallery, reviews the total amount (items, shipping, insurance), accepts these terms, then pays on the secure payment page. The sale is concluded upon payment. The buyer immediately receives an e-mail confirming the order and its details; the invoice is sent separately.

The gallery may refuse an abnormal order or one placed in bad faith; payment is then refunded in full.

5. Payment

Online payment is made by card on the secure page of Stripe, a licensed payment provider; the gallery never has access to card details. The amount is charged when ordering. Payment by bank transfer, payment in instalments or a leasing arrangement for businesses can be agreed on request, outside the website. The gallery retains ownership of the work or product until the price has been paid in full (retention of title).

6. Delivery and collection

Shipments leave from Dinard. Shipping costs include packaging (a custom crate for sculptures) and transit insurance up to the price paid. Delivery is free, insurance included, for any purchase of €5,000 or more delivered in France or Europe (European Union, United Kingdom, Switzerland). Some pieces, notably large sculptures, are shipped on quotation.

Shop products leave within three working days; works within about ten working days, the time needed to pack them; limited edition prints after printing. The buyer receives an e-mail on dispatch with the tracking number. Collection from the gallery in Dinard is free, by appointment.

On receipt, the buyer checks the parcel in the presence of the courier, records any damage on the delivery note and informs the gallery within three days, in writing, with photographs. For a consumer, risk passes upon taking physical possession of the goods.

7. Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, consumers have fourteen days from receipt of the goods to withdraw, without giving any reason. They inform the gallery of their decision by an unequivocal statement, by e-mail to info@galeriecalderone.com or by post to the registered office, or using the form below.

They return the goods, in their original packaging and in perfect condition, no later than fourteen days after communicating their decision. Return costs are borne by the consumer; a work must be returned packed and insured at its value. The gallery refunds all sums paid, including the initial shipping costs (at the standard rate), no later than fourteen days after receiving the decision; it may withhold the refund until it has received the goods back. The refund is made using the original means of payment.

The right of withdrawal does not apply to goods made to the buyer's specifications or clearly personalised: dedication, custom framing, a work or print made at the buyer's request outside the website's catalogue. Nor does it apply to purchases made by a business.

8. Guarantees and authenticity

Each work comes with a certificate of authenticity; editions are signed and numbered. Consumers benefit from the legal guarantee of conformity for two years from delivery (articles L.217-3 et seq. of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). In the event of a defect, they write to the gallery, which offers repair, replacement or refund depending on the nature of the goods.

9. Intellectual property

The purchase of a work or product does not transfer any reproduction or performance rights, which remain the property of the artist (article L.111-3 of the French Intellectual Property Code). Any commercial use of the image of a work requires the authorisation of the artist or their successors.

10. Personal data

Data collected when ordering are used to process the order, payment, delivery, invoicing and to follow up the relationship; they are kept for as long as accounting obligations require. Details are set out in the privacy policy.

11. Complaints and mediation

For any complaint, the buyer first writes to the gallery at info@galeriecalderone.com.

In accordance with the provisions of the French Consumer Code on “the consumer dispute mediation process”, after contacting us and failing a satisfactory reply, you may refer the matter free of charge to a consumer mediation procedure with:

These terms are governed by French law; failing agreement, the French courts have jurisdiction, subject to the protective rules of the consumer's country of residence.
